Wills and Estates Law: Legal Help for Estate Trustees

An estate trustee (or executor) is the person named in a will who is given the responsibility to manage a person's estate after death. It is not a simple task to wind up an estate and distribute assets to beneficiaries. It can be a complex and time consuming process requiring sound judgement and patience.

If you have been named as estate trustee, you have specific legal and fiduciary duties. Failure to fulfill these responsibilities and comply with all applicable laws, deadlines and regulations can result in costly and complicated litigation. The estate administration lawyers of Elliott & Hills have the knowledge and experience necessary to provide you with the advice and assistance to get the job done.

We provide professional advice and assistance to clients who have been entrusted with the responsibility of administering an estate. We can actively manage the process or advise you regarding issues, such as:

  • Winding up and administering the financial estate
  • Probating the will, if necessary
  • Obtaining releases
  • Opening an estate bank account
  • Paying final bills and settling claims against the estate
  • Preparing and filing of final tax return
  • Inventorying and managing estate assets
  • Identifying and locating next of kin and beneficiaries
  • Interpretation of wills and trusts
  • Asset distribution
  • Filing the Estate Information Return
  • Obtaining a Clerance Certificate from Canada Revenue Agency

To Our Valued Clients:
The lawyers and staff at Hills Nolan are taking all necessary precautions to ensure that we keep our work family, our clients and our colleagues as safe as possible during these extraordinary times. We have shifted our office to “virtual” spaces and we will be having meetings by telephone or videoconferences (using Zoom, a video platform). Please contact your lawyer or the responsible clerk via email. Currently, our receptionist and a limited number of staff are attending to deliveries, telephone calls and real estate transactions.

Given the rapidly changing conditions, this may change based on government directives or recommendations. We will do our best to keep you informed in a timely manner if conditions change and we need to adjust our current arrangements. For any new clients, please use the “Contact Us” link on our website.
Any deliveries of documents that cannot be emailed can be brought to the rear door of the office between 9 am and 5 pm. If you intend to drop off any documents, please call our receptionist to let her know. Please ring the bell at the back door and someone will be with you.

The health and well-being of our staff, our clients and our community is our highest priority. We appreciate your patience and understanding during this rather unique time! We must all do our part to “flatten the curve”.

We look forward to continuing to assist you in the same professional, high quality manner that you expect from all of us at Hills Nolan.
